Terms of Service

📋 Agreement to Terms

By accessing and using DryICE ("the Service"), whether through the web app or the Android or iOS apps, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

🧊 Description of Service

DryICE is a community-driven platform that enables users to:

  • Report sightings of Immigration and Customs Enforcement (ICE) activity, with an optional photo and notes
  • View community-submitted sighting reports on a map
  • Vote on the accuracy of reports and flag spam
  • Save favorite locations and receive push notifications about sightings nearby
  • View a separate map layer of publicly listed ICE detention facilities and field offices
  • Access optional Premium features through a paid subscription

âš ī¸ Important Notice About the Nature of This Service

  • Community-Reported and Unverified: Sighting reports are submitted by members of the public. We do not verify them and cannot guarantee that any report is accurate, current, or complete. Reports automatically expire after 4 hours
  • Public Facility Data: The ICE facility layer is compiled from public listings on ice.gov and geocoded automatically. It is provided for general awareness only, may be approximate or out of date, and is not an official government source
  • Not Legal Advice: Nothing in the Service is legal advice. If you need legal help, contact a qualified attorney or a legal-aid organization
  • Not an Emergency Service: DryICE is not a replacement for emergency services or official channels. Verify critical information independently
  • Lawful Use Only: You must not use the Service to obstruct, interfere with, or evade lawful law-enforcement activity, to harass, threaten, surveil, or dox any person (including officers or agents), or for any other unlawful purpose. Any such use is a material breach of these Terms and will result in termination of your access

👤 User Responsibilities

Accurate Information

  • Truthful Reporting: Only report what you have personally observed or have good reason to believe is accurate
  • Verification: You are responsible for what you submit; think before you post
  • Updates: Update, vote on, or delete your report if circumstances change

Appropriate Use

  • Community Benefit: Use the Service to help keep your community informed
  • No Misuse: Do not submit false reports, spam, or misleading information
  • Respect for Others: Do not include personal information about identifiable individuals (names, license plates, faces of private persons, home addresses) in reports, notes, or photos unless necessary and lawful

Location Services

  • GPS Accuracy: Enable location services for accurate reporting; you may also enter an address manually
  • Privacy: You control your location sharing through your device settings
  • Safety: Do not put yourself or others at risk to make a report, and do not visit locations that may be unsafe

Content Restrictions

  • False Information: Submitting knowingly false or misleading reports
  • Spam: Excessive, duplicate, or irrelevant reporting
  • Inappropriate Content: Offensive, discriminatory, threatening, or harmful content, or content that violates anyone's rights
  • Harassment and Incitement: Using the Service to target, harass, intimidate, or incite violence against any person or group
  • Commercial Abuse: Using the Service primarily for commercial promotion

Technical Restrictions

  • System Integrity: Attempting to disrupt, hack, or compromise the Service or its infrastructure
  • Data Mining: Automated scraping or bulk collection of report data beyond normal app usage
  • Circumvention: Bypassing security rules, access controls, Premium gating, or the spam-report system
  • Multiple Accounts: Creating multiple accounts to manipulate voting, spam reports, or free trials

🤝 Community Guidelines and Moderation

Respectful Interaction

  • Helpful Attitude: Approach the community with a spirit of mutual aid
  • Constructive Feedback: Use votes to improve accuracy, not to punish users
  • Report Problems: Use the spam flag or bug reporter to bring problems to our attention

Zero Tolerance for Objectionable Content and Abusive Users

  • No Tolerance: There is no tolerance for objectionable content or abusive users on DryICE. By submitting a report, note, photo, username, or any other content, you agree that it contains nothing offensive, discriminatory, threatening, harassing, or otherwise objectionable, and that you will not use the Service to abuse other people who use it
  • Blocking: You can block any account from one of its reports. Blocking immediately hides that account's reports from your map, list, and combined-report views, and it does not notify them
  • Reporting: You can flag any report for review from the report itself
  • Our Response: We review flagged content and act on violations — removing content, restricting features, or suspending or terminating accounts. You do not wait on us for the immediate effect: a report you flag is hidden from you straight away, and a report flagged by three or more accounts is hidden from everyone pending review

How Moderation Works

  • Spam Flags: Any signed-in user can flag a report as spam once per report. A report flagged by three or more distinct users is automatically marked as spam and flagged for moderator review and removal
  • Moderators and Administrators: Designated volunteers, moderators, and administrators may review flagged content, remove reports or photos, edit or remove profiles, adjust roles, and grant or revoke Premium access
  • Enforcement: We may remove content, restrict features, or suspend or terminate accounts that violate these Terms, with or without notice, at our sole discretion
  • Appeals: If you believe an action was taken in error, contact us using the details below

🔒 Privacy and Data

Information Collection

  • Your use of the Service is subject to our Privacy Policy
  • Location data is used to provide location-based features and notifications
  • Community reports are shared publicly to benefit all users

Data Ownership

  • Your Content: You retain ownership of content you submit
  • License to Use: By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and moderate it in connection with operating the Service
  • Responsibility: You are responsible for ensuring you have the right to share any content you submit, including photos

đŸ’ŗ Premium Subscriptions and Payments

Subscription Features

  • Free Tier: The core features of DryICE (viewing and reporting sightings, voting, favorite locations, notifications) are free
  • Premium Tier: An optional subscription adds features such as extended search radius, access to report photos, priority notifications, advanced analytics and data export, and custom themes. Features may change over time
  • Plans: Premium is offered as a monthly or annual subscription. Current pricing is displayed in the app and may vary by platform and region
  • Free Trial: New subscribers may be offered a 3-day free trial. A payment method is required to start the trial, and you will be charged automatically when the trial ends unless you cancel before then
  • Admin Grants: We may grant complimentary Premium access at our discretion; such grants can be revoked at any time and carry no payment obligation

Payment Processing

  • Web Payments: Processed securely through Stripe, subject to Stripe's terms and privacy policy
  • Mobile In-App Purchases: Processed through the Apple App Store (iOS) or Google Play Billing (Android) and managed through RevenueCat
  • Platform Terms: Mobile subscriptions are subject to Apple's and Google's respective terms and conditions

Subscription Terms

  • Billing: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date
  • Cancellation on Web: Cancel at any time from the Premium or Account page in the app. Premium access continues until the end of the current billing period
  • Cancellation on Mobile: Cancel through your Google Play or Apple App Store subscription settings. We cannot cancel store subscriptions on your behalf
  • Refunds: Refunds are governed by the policies of the platform you purchased through (Stripe for web, Apple or Google for mobile). We do not provide refunds or credits for partial subscription periods except where required by law
  • Price Changes: We will notify you of any subscription price changes in advance; continued use after a change constitutes acceptance
  • Expiration: Premium features are disabled when a subscription lapses or is revoked

⚡ Service Availability

Disclaimer

  • Best Effort: We strive to maintain Service availability but cannot guarantee continuous, uninterrupted access
  • Third-Party Dependencies: The Service depends on third-party providers (Google/Firebase, Google Maps, OpenStreetMap, Stripe, RevenueCat, app stores) whose outages may affect the Service
  • Maintenance: We may temporarily suspend the Service for maintenance or improvements

No Warranty

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not guarantee the accuracy of community-submitted information or the facility data layer
  • You are responsible for verifying information before acting on it

âš–ī¸ Limitation of Liability

Service Limitations

  • Information Accuracy: We are not responsible for the accuracy of user-submitted information or for decisions you make based on it
  • Safety: You are responsible for your own safety and the consequences of your actions
  • Availability: We are not responsible for losses caused by Service unavailability

Damages

  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim will not exceed the amount you paid us for the Service in the 12 months before the claim (or $10 if you have paid nothing)

You agree to indemnify and hold harmless DryICE, its maintainers, contributors, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, the content you submit, or your violation of these Terms or of any law.

ÂŠī¸ Intellectual Property

Service Content

  • The DryICE name, logo, and branding are owned by the DryICE project
  • The DryICE application, source code, design and content are proprietary and protected by copyright. All rights are reserved. You may not copy, modify, distribute, reverse-engineer or create derivative works of the App except as expressly permitted by these Terms or applicable law
  • Map tiles and imagery are provided by Google Maps under Google's terms. ICE facility listings are U.S. Government public-domain data

User Content

  • Your Rights: You retain rights to content you create
  • Community License: Content is licensed to us as described in Data Ownership above
  • Responsibility: You are responsible for ensuring you have rights to content you submit

📝 Modifications to Terms

Updates

  • We may update these Terms periodically to reflect changes in the Service or legal requirements
  • When we do, we will update the "Last Updated" date and, for material changes, notify you through the Service (for example in release notes or an in-app notice)
  • Continued use after changes take effect constitutes acceptance of the updated Terms

Notice

  • We will provide reasonable notice of material changes to these Terms
  • You may discontinue use and delete your account if you do not agree with updated Terms

🔚 Termination

User Termination

  • You may stop using the Service at any time
  • You can delete your account from the Account page or by contacting us; see the Privacy Policy for what is deleted
  • Reports you submitted in the last 4 hours remain visible until they expire, attributed to "Deleted User"

Service Termination

  • We may suspend or terminate access for violations of these Terms
  • We may discontinue the Service with reasonable notice
  • Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive

âš–ī¸ Governing Law

These Terms are governed by the laws of the United States and the state in which the DryICE project is operated, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.

📄 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
